Q: Payment of child support when the mother has signed a power of attorney

My husband pays child support to the mother of his 17 and 13 year old children. The mother has now signed a POA to house and home school the two children. Does my husband have to continue to pay the child support to the mother, or can the child support be sent to the family who is taking care of the children?

A: He should file a petition ( a request) in the court that set the support asking to change the payment to the care-taker family. ( He can't automaticly change anything about child support- it's set by a court order, so in the strict sense, only the Judge who set it can change it). He must comply with the existing court order until the Judge changes it. Under Tennessee law, the "child support Calculator" is a computer program available on line and the program takes into account the number of days each parent has, so if her days have decreased, it is likely the support figure might also change. consult an experienced family law attorney asap.
