Orlando, FL asked in Family Law for Georgia

Q: Hello I have a 1.5 yr old child whose father was convicted of a felony dealing w children.

I gave permission to my ex in his court hearing contact my child but didnt get into details. Assuming contact is only a phone call My question is...bc he doesnt have rights to our son is there a way i can prevent our son from dealing with his new fiance? I dont trust her but shes bound and determined to get rights even if she takes me to court. I worry if she wins bc her hatred for me and her obsession with my child she will do something harmful to him or run away w him if she gets rights. I know its dumb but my ex gets out of jail in 3 weeks and im very concerned.

A: The fiance' will have not grounds to seek rights to your child. However, the child's father may petition for legitimation and visitation. If he is ordered visitation, he will have discretion over whether he allows his fiance' contact with the child during his visitation periods.

A: She won't have any right to seek custody or visitation, but he can once he is out of jail. You may want to consult with an attorney who can review the facts of your case and present you with the options. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
