A: If I understand you correctly, you are an inpatient in a hospital room in which you awoke at 1:30 a.m. to find a maintenance man on a ladder in your room, apparently working on something. As a patient, whether you are in a private room or not, you do not have the same right to privacy as when you are in your own home or a hotel or motel. You are in the hospital's premises. You may want to talk to your nurse to let him/her know that the incident was unexpected and upset you. However, the nurse may have no ability to control who enters your room, for maintenance purposes of any other reason. All you can do is request that no maintenance workers enter your room except during regular working hours, and especially not during the late night sleeping time.

A: Without more details, it’s difficult to say. On its face, the scenario could appear curious to some observers, as to why the work was being performed at that hour, when the better part of maintenance in such facilities is often done during day shifts. Or it could appear as necessary, if circumstances arose requiring immediate attention to the ceiling for technical reasons. If you consulted with a California attorney, she or he might have further questions about the circumstances of the work and the conduct of the employee.
