Horseheads, NY asked in Contracts for New York

Q: A used car dealer marked the price of the car up after I signed the contract, is this legal?

I got approved for financing at a used car dealer, after I signed the paperwork I noticed they marked the price up on the vehicle in my contract from what it was originally suppost to be. Is this legal? I haven't gave a down payment or gave my trade in. So am I binded by law to take the car?

A: If you signed it at the higher price you are going to have a hard time undoing it. If they wrote in the new number after you signed that is illegal, but unless you have a copy with a different number, you will have issues.

A: For contracts in general, the fundamental elements are an offer, acceptance, and consideration. However, it is also necessary that parties to a contract have mutual assent. That means everyone is on the same page, to put it loosely and informally. If you are not able to resolve the discrepancy, an attorney could examine the contract and other evidence to determine what your rights are in this situation.
