Gainesville, FL asked in Animal / Dog Law for Florida

Q: My friend bought me a Yorkie puppy for my bday. We went to pick her up from the person, and were informed that she

had been given shots a week prior, and possibly she was having an allergic reaction to them because she was coughing and not acting herself and tired. I wound up staying up all night with her in the rocking chair because she just couldn’t settle down, There was certainly something not right with her. Long story short I took her to the vet as soon as they open the next morning and they told me I needed to rush her to UF small animal hospital. They thought maybe she had an absceesed lung from having pneumonia for so long and that they were not equipped to deal with So I took her there, they assessed her said that they wanted to put In the oxygen chamber for a couple of days and give her some antibiotics. I kept her in oxygen for five days and there was no change they wanted to do a pet scan and Other tests, but I decided that at seven weeks old this little baby had been through enough and probably wouldn’t make it. Do I have any recourse to recoup my money?

A: Recoup YOUR money? It was a gift. If you mean the veterinary expenses, not in excess of the value of the puppy (what your friend paid for it). Even then, you would have to prove that the giving of the shots was negligent. I don't think you have a case.
