Cincinnati, OH asked in Family Law, Child Custody and Child Support for Ohio

Q: Single mother in ohio

My child’s father pays child support after I took him to court for it. He never asks to see my child he only saw our child once. Our child is now one years old. If he were to take me to court and asks for joint custody and proves he makes more money than me , is there a chance he be granted joint custody? Or can I suggest supervised visitation because our child isn’t familiar with him. Does the amount of money he makes effect anything?

A: He always has the right to go to court and ask for parenting time and custody. The court would decide what is in the best interest of the child at that time based on all the evidence properly presented to the court. It could order supervised visits to start, and then increase the parenting time later. Both of your incomes are considered in determining child support, but incomes do not determine custody.
