Irving, TX asked in Contracts and Landlord - Tenant for Texas

Q: Lease termination confusion and fine print misconception.

Hi,

I have perfect credit score and so does my husband. We have perfect renters history.

We live in DFW area. We leased apt for 10 months the lease ended Oct 1st 2018. We went to return key to leasing office. And they said that you need to keep paying rent since you did not give us 60 day notice. My question is when we sign lease with end date. In fine print the leasing agreement states that we need to give 60 day notice. But the leasing office did not email or put notice on our door for continued contract to remind us either. We were under the impression since the lease is till 1st October we need not give any notice. Now we have moved in new place already and they want us to keep paying rent for 60 days. How can I get out of this. The leasing office management is very rude and won’t listen to any explanation and the whole reason for move is that whole community is infested with roches and bed bugs. What should I do?

A: I suggest a call to the health department if the dwellings are uninhabitable. Your area may also have a local lease agency that helps people with issues such as yours.
