Asked in Contracts and Real Estate Law for Texas

Q: What do I need to do to apply for funds (estate) that was deposited into the registry of the court per a court order

My mother received a court order stating that her share of net proceeds from the sale of my grandparents house shall be deposited with the registry of the court. This order was a result of an emergency hearing applied for by my two aunts which they stated that my mother was in breach of contract because she refused to sign the sale contract for my grandparents house prior to hearing. She requested more information concerning a line item on the contract before she would sign, which was not made known to her prior to signing date. Once she received the additional information she was in agreement to sign the contract two days after the original signing date (09/10/18), but was not allowed to by the real estate agent due to this court order. My mother received the additional documentation on 09/11/18 and was preparing that day for a medical procedure that was scheduled for 09/12/18 (which she was unable to drive afterwards). The hearing was on 09/12/18, which my mother did not know.

A: If the funds held in the registry of the Court belong to your mother, she should contact the register's office for instructions to withdraw.
