Q: my husband is a prior felon and we picked up charge of dangerous drug and possesion of paraphinaila class 4 and class

they split charges and gave him just dangerous drug possesion we fell under prop 200 but i got probation and he is looking at prison we want to fight to get him rehab or he want to c if we cant get him like 5 or 10 years probation in stead of prison is it possible the public defender he has now is not trying for what we asking we looking for a pro bono lawyer or somebody that will work with us till we can get jobs to make payments

A: It is always in your best interest to fight the charge and try to get a better deal. With the type of charge your husband is facing and the fact that he has prior felonies, it might be difficult to negotiate because the prosecutor will want, at least, some jail time. Asking for that much probation time without prison is not likely but it at least shows a willingness to get help and not pick up new charges. It is possible the public defender you have is being overworked and not fulling getting what you want. I would not recommend a pro bono attorney because they are likely more busy and less effective than the public defenders. Hiring a private attorney for class 4 felonies is expensive but many, including our firm, do offer down payments and payment plans.
