Q: And I sue the probation department?

Can I sue the probation department ?

I am currently on probation and have been going through this situation for a couple of years now. It's almost as if I'm afraid to make any moves because I don't want my parole officer to come up with anything to send me back to jail. I am working, never test dirty, and I'm staying clear of any trouble. The problem that I'm having is, while incarcerated before probation I was injured by the sheriff's at the jail and almost died. Long story short, I got an attorney, sued the Sheriff's Department and won the case. When I was released from jail my check was given to the probation department. They put it in a safe deposit box. The judge over my probation, who I have to check in with every three to six months to see how I am doing, told my probation officer to issue my settlement check. The check was "misplaced". They worked on getting the check again, got it, I saw it, the judge saw it. But they still failed to give it to me, now it's "misplaced" again.

ANYONE CAN SUE AT ANY TIME. THE PIVOTAL ISSUE IS USUALLY WILL YOU PREVAIL AND DO YOU HAVE THE FINANCES TO HIRE A LAWYER.

HOW MUCH WAS THE AMOUNT OF THE CHECK?

MAYBE A LAWYER WOULD TAKE THE CASE ON A CONTINGENCY IF THE AMOUNT WAS SUFFICIENT OR YOU CAN PAY A LAWYER ON AN HOURLY.

I WOULD THINK YOU COULD HAVE A STOP PAYMENT ON THE CHECK AND HAVE A NEW ONE ISSUED????
