Q: Is it possible to get sole custody with no visitation rights?

Hi, I was wondering if it would be possible to get sole custody with no visitation rights from the father. He is addicted to alcohol and has started using drugs (heroin, cocaine) again. He abused me when I was pregnant. He has not paid any child support and has not seen the children for a couple of months. I have plenty of pictures and videos and conversations threatening harm to me, of his alcohol problem, etc. We have never been married. Also, would it be smart to wait it out and see if he files for custody or go ahead and do it myself. I do not believe he would file.

Also, this might be a separate question, but how hard would it be in order to win a step parent's adoption case in this scenario as well.

A: It is possible but certainly not a sure thing. You can probably defeat the presumed 50/50 parenting time with the issues you raised, but the court may want to take a crack at supervised visitation before it goes to the extreme with no visitation.
