Orlando, FL asked in Child Support and Divorce for Florida

Q: Clarify Child Support for my 3 children - Said support shall continue until all children have turned eighteen(18) year

My oldest is now 19 and ex stopped paying when he turned 18 even though he was still in H.S. Doesn't the statement mean that he continues paying the full amount for all three until ALL children have turned 18? Exerpt;

...Said support shall continue until all children have turned eighteen (18) years of age, graduated high school after age eighteen (18) but before age nineteen (19), emancipated, married or deceased, or until a court of competent jurisdiction subsequently orders otherwise.

I have also noticed that I have been paying for my $300K AND his $500K 20 year term life insurance policy for all of these years when he should have been paying for his.

He left the day after he finished his Residency and Fellowship to become a Trauma Surgeon. I never pushed to change any payments. The children were so young when he left that we never considered what happens at this time in their lives with car insurances and repairs, etc. In 2 yr I am paying near $11K ins for 2 boys cars

A: In general the law in Florida is that child support is recalculated as each child emancipates. If the two of you do not agree as to what the language means then your remedy is to return to court for the judge to decide. Same with the life insurance. If he does not agree to pay for his own as ordered then you must return to court.
