A: much more info needed..........

her age; when; one incident? what court?

if she told cops they will try to get the case filed...................hire a lawyer now for your brother so the lawyer can try to talk the cops/filing deputy DA out of filing.

if you don't know a lawyer, let me know what court and i will give you a few names

A: The District Attorney decides whether to pursue charges, not the niece. However, if the niece refuses to testify, there is likely not enough evidence to get a conviction, so the charges may not be filed or may be dismissed if already filed.
