Fullerton, CA asked in Car Accidents and Small Claims for California

Q: Can an ins. co void our policy because I didn't include room mates in "household members"?

The other party didn't have insurance but I supposedly had full coverage. I was injured and lost about 2 weeks of work I never received any help only that they wanted to verify the car was damaged and my personal info. I got a lawyer to help me but they couldn't after they found out the person at fault had no insurance and my insurance was voiding the contract due to "material misrepresentation". Now I'm paying off a $13,000 car but its totaled and i'm struggling to catch up on my bills. They offered me a refund of the payments I've made since the policy began, a total of $1,133, but they still have my totaled car that I could sell for parts at least? They still haven't contacted Carmax to see what I have to do from here out. What should I do??

A: No one can answer without reading the policy, the lease agreement, the traffic collision report, and knowing the dates that the room mates began living with you.
