Q: Can I get a refund from a gym for initiation fee and monthly dues if i cancel my membership because of their misconduct?
I paid $109 to a gym for a membership (initiation fee, first and last month dues) but three weeks later I decided to cancel as a response to a bad attitude they demonstrated towards my friend and the fact that the AC didn't work a single day of my membership. I've sent them an inquiry but i anticipate they won't refund me so I'm considering taking a legal action. Should i complain to the city attorney? Should i file a suit? Thanks!

I do not practice in California, but a place to start could be to read the terms of their membership contract, checking for provisions about cancellation. You could consult with an attorney in California as to what your most cost-effective options could be in light of the amount of damages at hand.
