Q: Can I get a refund from a gym for initiation fee and monthly dues if i cancel my membership because of their misconduct?

I paid $109 to a gym for a membership (initiation fee, first and last month dues) but three weeks later I decided to cancel as a response to a bad attitude they demonstrated towards my friend and the fact that the AC didn't work a single day of my membership. I've sent them an inquiry but i anticipate they won't refund me so I'm considering taking a legal action. Should i complain to the city attorney? Should i file a suit? Thanks!
