Duluth, GA asked in Divorce and Family Law for Georgia

Q: I received a letter from my husband lawyer - Motion to Appoint a Guardian AD litem via the mail. How do I respond ?

I received a letter from my husband lawyer - Motion to Appoint a Guardian AD litem via the mail. How do I respond ?I was also served petition for modification of child custody and parenting time by the sheriff, which was recorded at the court house. Do I respond to both (the one by mail and from the court house) or do I respond only to the one recorded at the court house.

The letter that was sent by mail appears to be mere accusations. They provide essentially his accusations that he plans to use against me

A: Yes, you will need to respond to both. Custody modifications are complex matters. You should not go at it alone. You should consider consulting with an attorney to review the documents that you have been served with and discuss your options.

A: You should definitely consult an attorney regarding your options. In general, a Guardian ad Litem is someone appointed to look after the best interests of the children and make recommendations for custody. All motions should be responded to, and it's best to hire an attorney to help you.

A: You will need to respond to both, but I agree with my colleagues in that this is something you don't want to handle on your own. You should consult with an attorney who can help you with the proper course of action. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
