Q: Joint custody every 3 months til child starts school. She’s in school for about 6 months now. Custody still apply?
joint custody tidy says child be with each parent 3 months at a time til she starts school when she does we need a new court date to discuss new terms. Problem is he haven’t showed up to none of the court dates. She’s in school now and if he gets her he won’t bring her to school and has told me he will keep her away from because it’s his custody. What do i do? Do the custody still applies even though she’s in school?
A: Yes the Judgment still applies until there is a new one. You need to hire a custody attorney to file a Motion to Modify. If he doesn't show up, you get everything you want.
