Q: My kids and my wife are affraid of getting into car because of recent drunk driver accident.

I was parked on frontage rd hooking up car trailer when i went to get in to move truck thats when the drunk driver hit me on the driver side and it pulled me back out of truck and my wife was at the back of truck watching me disappear . i ended up under truck and my left shoder very soar and tail bone badly bruised. My wife is in shock and is affraid of getting into the car now as well as my kids and both kids had minor bruises

A: You, and they, have good PI cases. Contact a PI attorney to discuss it in detail. You need to get medical treatment for a diagnosis of your injuries and off work order to justify any loss of wages. Take photos of visible injuries, damage to the vehicles and collision site. If the other party doesn't have insurance, or has minimal limits, your UM or UIM coverage will apply. It doesn't cost anything to talk to a PI attorney about a case.

I am assuming you are treating with a doc and if not your lawyer would help you get one. However, a break in treatment or getting treatment will hurt your case.

your family arguably also has a case under Dillon v Legg b/c they were damaged by viewing it.

you have a claim against the other parties auto ins, and then against your own co. if the other party was not insured or your coverage was greater..........
