Q: Can my mother force me to sell my house. She moved in to my house 6 years ago, and paid off the mortgage. My kids are I

I had equity in the house. Both of our names are on the deed. My kids and I don't want to move. Can I buy her out,paying her back the original amount, or do I need to give her 50% of the market value and sell our family home.

A: This is the type of situation where you will need to talk to a lawyer in a private consultation. After hearing all the facts the lawyer will be better able to help you sort out your legal options. There is a way a part owner of a house can try to force a sale but whether or not they will be successful depends on the facts of the situation which is almost always proving the original intent of the parties. It might boil down to determine if adding your mother to the title was to help her secure a loan or whether it was truly to make her a part owner. So gather any and all documents you have showing the communications you have had with your mother about the transaction which led to her being added to the house title. But documents I mean text messages, emails, letters, notes on paper napkins, face book posts, twitter tweets, etc. Then make an appointment and talk to an Attorney about the situation.
