Q: Can my landlord charge me extra month rent because my 30-day was served to her on the 3rd instead of the 1st?

My lease says on MTM basis notice must be given 30days prior to end of initial or renewal term. So if I gave a notice on Dev to move out by end of the month is that no valid? My landlord said it wasn’t full 30 days so sent a corrected letter Dec 4th stating that the previous notice had an error and my intent was to move out no later than Jan 1. She said it still was invalid because it want given to her on the 1st she wants to charge for the entire month of Jan and take my deposit. Please help.

A: If you did not give the full 30 days written notice as required by the lease agreement, then landlord can charge you an extra month rent - and you can remain living there for that extra month. If you leave and don't pay, then landlord can deduct from your security deposit, or sue you, or make an adverse entry on your credit report, lowering your credit score and making it more difficult to rent from a landlord who checks.
