Knoxville, TN asked in Criminal Law for Tennessee

Q: In order to indict on agg buglary doesn't a theft felony or assault have to be proven and just not hear say of witnesses

The only evidence they have is two live in witnesses that claim they saw me running from the residence at 3am, and that the window was lifted and contents of a purse was dumped out , however there is a camera on front porch that covers the window that was supposedly forced entry and I have a live in witness that can place me at home in bed at the time of alleged crime and it's been 4 months and the da still has not presented my case to the grand jury for indictment, think this is enough to indict me? And they didn't report a theft felony or assault either and it's there word against mine is this enough to indict me and can hear say convict me?

A: You should hire a lawyer who can go to the DA with your evidence.

It will be a lot less expensive to retain an attorney now then go to jail and fight the charges.
