Clinton, MD asked in Criminal Law for Virginia

Q: Can someone film you at your front door without your consent?

My wife didn’t know she was filmed when our neighbor came knocking on our door after quiet hours at our apartment; only reason we knew is our apartment told us they watched this video because the neighbor didn’t know what they would encounter when coming to my door to harass my wife.

A: I doubt there is any issue with someone doing this. If my neighbors were throwing a loud party and I knocked on their door to confront them I would want to have video. Maybe there is a civil remedy but I don't see anything criminal based on what you said.

A: In VA, only one party to the video recording needs to know the recording is being conducted. Obviously the person doing the recording is well aware he/she is recording. If your wife was harassed, this recording could well help her when she files a complaint of harassment with the county magistrate's office.
