A: If your employee was acting as your employee at the time, yes, you are responsible for their actions. It it called the doctrine of "respondeat superior". The general idea is that a owner business is responsible for the activities it undertakes.

A: If the employee is within the course and scope of employment, yes. Ordinarily, if the employee is going to, or coming from, work that is not considered to be course and scope of employment. Notify your commercial auto carrier. It will sort out the liabilities.
