Las Vegas, NV asked in Criminal Law, Estate Planning, Family Law and Elder Law for California

Q: Good Morning My father I see has been taken advantage by my brother and I'm in need of your advice.

My brother was made trustee of my fathers 10 properties about 21 years ago and I just found out that all those properties are now in a corporation. According to my father he agreed to have him (brother) take care of the properties with the understanding that my brother would be taken care of my father. I spoke with my brother yesterday and he told me that's not true. He (brother) does provide a roof over his head and minimal assistance but that's it. My father now survives on an income of $1,200 monthly from his social security check. That he sometimes doesn't even receive because there has been times that my brother doesn't give him that. My father is now 82 years old and has no other income for his future heath issues. At the time when my brother was made trustee the 10 properties were all paid for but since according to my brother there is a debt over $800,000 My brother made himself a pastor and operates half way house with those homes and my father gets no revenue from it.

A: More information is needed to fully understand the facts and to give an accurate answer.

However, you are always best advised to retain a LOCAL lawyer. What city are you all in? In other words, you do not hire an LA lawyer for a case in Palm Springs or OC and visa versa...

This may be Elder Abuse but further info would be necessary....and it is not my area of law.

Is your dad competent to share the facts with a lawyer? Does he have any proof?
