Asked in Family Law and Child Custody for Florida

Q: Is my daughter's father allowed to make changes to her extra-curricular activities after years of not being involved?

I filed a child support modification earlier this year and was recently granted an increase during an administrative hearing that was requested by the father. He never showed up to the administrative hearing and a final order was reached for an increase of about an additional $800/month on November 6th starting December 1st. Two days ago he showed up to my job threatening to take me to court for custody stating that he would not allow her to engage in her extracurricular activities during his weekends or he will give me $420/month & not fight for custody. I do not mind time sharing & have always tried to keep him involved & I have never kept him away from her. He has not been very active in her life. She has been a competitive cheerleader for over 6 years and it requires traveling to competitions on the weekends (about once a month from Nov-May) and practice during the week. Is he allowed to interfere with her lifestyle in that manner for the sake of lowering his monthly payments?

A: It appears from you question that he already has the right to visitation on certain weekends. If this is so, he will not have to take you to court; he can control her activities during the time he exercises visitation.
