Q: The sellers agent asked my agent our ethnicity and then stated that we “Latinos” don’t ever do anything right.

Then we expressed our feelings about his statements and then changed it to him having issues with Latinos agents and buyers in his past. We had the strongest offer according to him before knowing we were Latinos. After knowing he asked for more money in the EMD and then said they will call us the next day. He said there was a stronger and better offer so they will not move forward with us. THE HOUSE IS STILL AN ACTIVE LISTING! It’s been a week and a few days since this occurred. Was i discriminated against? My agent said he’s filing something with the GCAAR but what can i do? That was the house for my family’s future and now we lost it because we are Latinos.

A: Sounds like a fairly clear housing discrimination case. The good news is that a prompt strategy of asserting a lis pendens and filing the proper complaint may get you your new home, and there may ultimately be an award of legal fees. The bad news is that few of the lawyers qualified to pursue such claims are willing to take them based on a future attorneys fees award. The best strategy is a quick demand letter before there is another contract on the property, but that will require quick action before the holidays and a retainer.
