Q: My discrimination/retaliation complaint against my employer is under investigation; when should I obtain a lawyer?

I have a formal written complaint from HR; 20 employees are being interviewed.

A: You should immediately begin the selection process for a good lawyer or law firm which focuses on the representation of employees in discrimination and retaliation cases. There are numerous highly qualified firms out there very capable of representing you.

You don't mention, however, who is conducting the investigation. I hope the case is being investigated by the California Department of Fair Employment and Housing (DFEH) or the federal Equal Employment Opportunity Commission (EEOC). If not, you will need to file your claim with either one of those agencies. And remember, time is of the essence in making sure you file your claims within the statutory time (300 days for the EEOC, or one year from the date of the discriminatory or retaliatory act by the employer for the DFEH.)
