Gilbert, AZ asked in Car Accidents for California

Q: Hello, I am contacting you today because I was in a car accident over 2 years ago.

The car accident took place in California. I now also reside in California and the people I was involved with in the car accident also reside in California. This is a civil case being held in The Superior Court of Arizona in Maricopa County. My problem is that they are holding my mother liable for this accident. She was served paperwork and because she does not read in English she did not understand she was being held responsible for this or that she was being called to court. There is a lot more information I can give but I am limited here so bottom line is I am looking to get this case dismissed as it is gravely affecting her mentally. She is a senior citizen that needs to be removed from this case that I am liable for not her! And I also believe it is a case that belongs in the state of California not Arizona.

A: Your lawyers can ask to transfer the case but usually Courts go with where it happened, but as both parties are California that may work.

As to you, if you have a claim I assume you have a lawyer. If you were at fault your insurance company will get you one. Either way, it's a problem that people can work out.
