Q: What to expect at a 1st Appearance of Carry/Possess Pistol w/out permit in Minnesota. Offense level of Gross Misd.

It says I will be booked prior to my court appearance. Does this mean I will be put in jail or will I just appear before the judge set the court date at this time? I'm a single dad so need to make plans for my child if I'm going to be put in jail at that time. Thanks for any help you can give me of what to expect at this hearing.

Thanks for the responses. One more question: I am low income, will I be assigned a court apointed laywer at this time or is this something I should be doing before?

A: Booking is a process where you are photographed and fingerprinted. Depending on the county that might occur at the courthouse or at the jail. But that does not mean that you will be held in jail for any period of time.

A: The booking procedure is a term used to describe identification procedures used by police following an arrest, or under other circumstances. For more serious crimes, the court may want the defendant "booked," and may have a way to accomplish that without putting the defendant in jail. The identification procedures include photographs, fingerprints, and questions relating to identity. If a court Summons instructs you to report for booking prior to a court appearance, that means the court may have a booking room near, but it shouldn't involve jail. The process usually takes about 20 minutes, apart from waiting time.

Beyond that, at the First Appearance your defense attorney will begin the work of defending you from the charges.
