Dayton, OH asked in Criminal Law and Federal Crimes for Ohio

Q: I don’t understand why looking at non forced photos of children for sexual desires is illegal, why?

If bob enjoys in private photos of children in a bathtub or children at the beach for his sexual desire then what reasoning is there to make this illegal? I understand it when children are being forced into positions for taking certain photos but I’m not referring to photos that are obviously forced by the photographer. I see no victims in the case where bob enjoys photos in his private life of children naked or clothed but not forced. Please help me better understand this, thank you.

A: For one thing, the children involved would have no way of even understanding the purpose of the pictures and therefore no way to offer informed consent. For another, people act on their desires, particularly when those desires are confirmed as being appropriate, or tolerated. For another, there is no good way to determine which images involved force or coercion. It’s arguable that all such images are forced since the child cannot understand what they are for invloved in.

Legalizing such imagery would open the door to real world actions in a dangerous way while making it illegal sends the signal loud and clear that children are off limits. If you find yourself attracted to such imagery, I strongly urge you to seek psychiatric counseling before you wind yourself up in prison.
