Buford, GA asked in Family Law and Divorce for Georgia

Q: Father has every other weekend visit w/our son (Friday after school until Sunday night) but he never picks up our son

On his Friday visitation, father only wants to pick him up Saturday night and drop off our son Sunday night. Can the father do this? Do I have to agree? What can I do?

A: You do not have to agree, but you need to weigh the importance of spending time with his father against the inconvenience of him not maintaining the ordered schedule. You may also want to consider a modification of the current parenting plan if he is not consistently exercising his scheduled time.

A: I agree with my colleague, you don't have to agree to it if it's not what your order states. However, you may want to discuss it with him. Does he have a good reason for not doing the pickup on Friday? Should you do a modification? There are more issues to consider here... -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
