Houston, TX asked in Criminal Law for Texas

Q: What's is my son facing for failure to appear in court?

He was charged with aggravated assault last year February 2018. On May 2018 the state picked up the charge and filed aggravated assault charges against my son. So he had a court on that charge on September 2018 , the judge sent him to jail. I posted a bond for him and on his next court date November 29, 2018 . The judge ordered a urinalysis drug test that same morning. We went but he couldn't urinate because the man was watching him and my son has a physiological problem. Since that day he tried over and over but couldn't. He had court on February 7, 2018 and failed to appear. I want to know what's going to happen to my son. Help!

A: The Judge will PROBABLY hold the bond insufficient (of forfeit the bond), a warrant will issue for your son's arrest, and once he is arrested and is a flight risk, the Judge will not allow any bond or set the bond so high that you will not be able to post it. If that is the case, your son will remain in jail until his case is resolved. Talk with his attorney. Good luck.
