Q: Can you provide Summary Administration representation and provide the associated cost information? See below.

My mother, She died in NY State without a will in 2012 owning 2 lots in the Rainbow Park sub division. All other assets of her estate have previously been distributed among the surviving 3 children .The taxes on the properties have been kept paid up to date without a legal transfer.

I'd like to affect the property transfer and resolve the "probate" issue expeditiously and economically. Hopefully it is a simple probate and qualifies for a Summary Administration. All children agree with the transfer of the properties to me. I am in the area (Ormond Beach) until April and available to work from my end to expedite the transfer of ownership.

A: Costs vary dramatically from law office to law office and can be hourly $250 to $450 or more, or some offices will work with you based on a flat-fee or there are Florida Statutory fees that are deemed acceptable, roughly 3% and so forth. Also, if probate has been completed, an Ancillary Probate may be applicable in Florida as well as an option. The reality of the situation is that cost can vary drastically and it will be necessary to review precisely what needs to be done by any attorney trying to assess the work that will be needed and the time that will be necessary to accomplish what you are requesting. It will also matter who was the personal representative in the original probate in your mom's home state and other factors will be applicable as well and documents needed. Getting copies of the deed for each property here in Florida would be an excellent starting point as well.
