Asked in Family Law, Divorce and Child Custody for Georgia

Q: If something happens to me can I set up where my kids be taken care of by my family instead of their dad?

One child we have in our divorce decree so I think he may have rights to that child if something happens to me. Just wanting answers because right now I have the kids dad on my life insurance thinking he may get the kids. Because if he could get the kids which I don’t want him to separate them I still want my kids to not struggle.

A: You can not will away children in the event of your death. If the unfortunate should happen, the father can petition the court for custody of the children.

A: I agree with my colleague, the father has the right to seek custody of his children if something were to happen to you. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
