Columbus, GA asked in Family Law for Georgia

Q: I received court papers from dfcs lawyer and they lied about alot of information on me. What can I do about that?

How I got this case is, my daughter was at her daddy's house and police & dfcs showed up one morning. They told him they had got a report of illegal use of drugs & selling drugs. No drugs were found they walked threw the house everything was ok. But she was placed with her paternal grandma. When they called me, they told me they had got a report about an unidentified male was arguing with his babymama & there was illegal drug use & selling out of that address. We were told different things. The dfcs investigator said she needed to meet with me so she can put my daughter back in my custody. When I met with her she started talking bout a case plan & what I needed to do to get my child back. I don't understand why I had a case or had to work a case plan when there was no drugs found & everything was ok at her daddy's house. So what right did she have for removing my child & my having to work a cade plan when the report wasn't made & me & I don't live with her daddy?

A: Are you working with an attorney? If not, you should consult with an attorney who can review the facts of your case in detail and help you plan the proper course of action. There has to be a compelling reason why they removed the child and that they are having you work through a plan to gain her custody back. Without knowing that information in detail it's difficult to provide you with direction on how to handle the situation. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
