Q: If a landlord in Va does not return your deposit back in the allowed 45 days what is the best course of action forward?

Previous landlord held rent deposit past the 45 day timeframe, on the 48th day the deposit was returned with a list of deductions which had not been presented in writing or verbally before the expiration of the 45 days. 1/3rd of the deposit was returned.

A: You can bring a lawsuit against the landlord for breach of the lease agreement but you have the burden of proof to persuade the judge that your claim should be decided in your favor. If you proceed on your own without an attorney, you may have problems with the proof.

A: You can sue your landlord if they didn't comply with the lease agreement and/or the VLTA if that applies.
