Dallas, TX asked in Child Custody, Child Support and Family Law for Louisiana

Q: How can I forgive child support arrears?

My ex and I have had bad luck coming to agreements in the past, but all of that changed. We are in the process of changing our custody to make him the domicile. I also wajt to forgive all child support, future and past. He was found in contempt of non payment, that I filed for, last year. Since then he has made all payments on time and we have agreed to remove it from our custody plan. Our child support was never set up through the state child support services, it was all just bank account to bank account. How do I go about forgiving arrears?

A: That can be done in the judgment changing custody. It would just need to specify that any and all arrearage is satisfied and/or forgiven. I would suggest having an attorney prepare a voluntary transfer of custody. Give me a call and I'll be happy to discuss the process and potential costs, including attorney fees and court costs.

A: Go to a mediator who can draft this judgment for the two of you.
