Denham Springs, LA asked in Criminal Law and Domestic Violence for Louisiana

Q: How likely will my Uncle's 3rd offense domestic violence case be dropped ?

In the past he was married to a woman that put false charges on him he only pleaded guilty so he could get back to his son. Now years later him &his girlfrnd went on a date and had a lot to drink that night they got into a confrontation and her mom made her file a police report she didn't want to file. She wrote a letter to his mom when she was sober explaining It was a misunderstanding about what happen and when he brought it to court in February and said he didn't want to plead guilty and the "victim" wasn't coming to court to testify he got upset and remanded him back to jail. But before reading the letter he had a trial date in June but after reading the letter he got upset then remanded him. No explanation why. He hasn't done anything wrong while out on bail and now he's got a court date March 25th. Are they just trying to get a conviction out of him by returning him back so they won't take it to trial ? Is it legal for her to have even made a police report while intoxicated ?

A: Your uncle needs a criminal defense attorney. This is too complicated to answer on a website
