Q: Probation revocation is possibly In the process to take effect.

I am currently on deferred probation. My sentence was 5 years for criminal mischief for damaging a vehicle. I have until May 2021 to complete. I have met all requirements except 1 drug class left to take for failed UA. I have recently been released from incarceration spent 92 days in county & 6 months at ISF in Henderson Texas after receiving a PI st a bar. I reported last Monday & was suppose to return the following day for UA but I have failed to do so, and she has advised me violation will be made if this isn’t done. I have been struggling since I have been home with personal issues as well as issues with my mental health. What do I need to do?? I want to try to get time served or work release possibly weekends I have less than $2,500 left owed in restitution from $6,003 that was the original balance. I have obtained my high school diploma, did all classes except mentioned above, and completed 300 hours community service, never missed curfew nor received any additional charges.

A: Any time spent in jail awaiting transfer to an ISF facility, and the time spend in the facility is considered a condition of probation and does NOT court towards time served on any sentence. Comply with your PO's request. Good luck.
