Q: I had a work related injury in 2016 on my foot which in resulted in a surgery and doctor rated me 13% disability

And I have arthritis from it they are offering me 27,000 and a school voucher to settle I want to ask for more does it seem like a good offer? And also the QME doctor recommended that I see a psychologist my lawyer said that even if I see one I will not get more money if they say I have a mental problem is this true ?

A: If you already have an attorney, it would be unethical for other attorneys to communicate with you about your case. If you don't trust your attorney, you should get another one.

A: More info is needed to properly evaluate your case. .........AND YOU NEED TO CONSULT A WORKERS COMP LAWYER NOT JUST AN EMPLOYMENT LAWYER......IF YOU DO NOT HAVE ONE YET.

What you are doing is the same as asking a doctor to diagnose your problem over the phone when you say I have a stomach ache, can you cure me and what will it cost?

However, it is always a good idea to contact a local attorney proximate to the court to which you would appear.

In other words, I am in Palm Springs and you don’t want to hire a Palm Springs lawyer for an LA case.

Most DUI, WORKERS COMP AND PI lawyers will offer a free consultation to review the facts. Most other areas of law are handled on an hourly, and thus I always suggest a prospective client write out a detailed summary in a page or so. That way you are not paying a lawyer to play secretary. However, if this were a straight non work accident i probably would not be interested because you have been talking with the insurance co and there is no way to know what you said or WHAT THEY THOUGHT THEY HEARD YOU SAY.

A: It might be good, it might be horrible! YOU HAVE A LAWYER, that lawyer is going to take a big chunk of your money... if this isn't a real lawyer and isn't a specialist in Comp, go get a real lawyer.

If you have a psych claim, there is no permanent disability, but the insurer is reponsible for treatment of a psychiatric industrial injury...how much is included to cover treatment with a psychiatrist?? There is just no way to know with the info you've presented. We can't even tell if the 13% is 13% Permanent Disability or 13% Whole person Impairment.
