Rosemead, CA asked in Criminal Law for California

Q: What can i do to ensure that video from another case clearly showing the same team of officers planting dope is used?

1.My house was raided by LASD. I had NO dope at the house.

2.held me because they said they found a scale and wanted to look thru my text messages. Also they IMPLIED that they had found something and wanted me to snitch. I agreed to work with them and they let me out.

3.Then i renegged and decided not to work with them so they told me to show up to court for which they had indicted me for sales for 36g of heroine they said they found in the raid. Which was not true.

4.My prints were not on the dope.

5.They did find incriminating texts.

6.Video footage exists from another case that clearly shows the same cops planting dope during a raid.

7.The video was never used because the defendant found the video footsge on his computer after he had already made a deal to work with police and been released.

8.The cops did not know the film existed.

9.In a third case, a guy tried to use it but a judge said not relevant. What can be done to use in mine? Should i go to internal affairs?

A: More info is needed to properly evaluate your case. Don't discuss your case on a site like this. It is discoverable.

If you have a lawyer go over this with him/her. If you don't ask the court to appoint a public defender at your arraignment.

What you are doing is the same as asking a doctor to diagnose your problem over the phone when you say I have a stomach ache, can you cure me and what will it cost?

However, it is always a good idea to contact a local attorney proximate to the court to which you would appear.

In other words, I am in Palm Springs and you don’t want to hire a Palm Springs lawyer for an LA case.

Most DUI and PI lawyers will offer a free consultation to review the facts. Most other areas of law are handled on an hourly, and thus I always suggest a prospective client write out a detailed summary in a page or so. That way you are not paying a lawyer to play secretary.

Call a local attorney to discuss your matter in more detail and to request an appointment.
