Does it depended on the case type or do they have a certain amount of time before they can no longer bring the case up? Could the defendant go back to court to get the without prejudice removed from the case? The case was dismissed due to uncooperative witness and the witness even wrote an affidavit stating that they was lying about the whole ordeal but the witness never came to court.
