Los Angeles, CA asked in Domestic Violence for California

Q: Can I still file a police report and file charges for domestic violence even after a few days or week?

I used to live with someone that always got physically abusive. He'd leave bruises all over my body, and he actually fractured/broke two of my fingers. When I would threaten to call the cops he would usually take my phone by force and throw it and wouldn't let me reach for it "until things cool off". Whenever this would happen that would be the case. Or he would threaten me with other things if I said anything to anyone. I believed it at the time and sometimes still do. About a week ago, almost two, we had another huge fight where he again got violent, and that's when he fractured my second finger. I told him he had to leave and get out. I didn't call anyone, instead just cried he made me believe it was my fault. He finally got his stuff and left my house a week ago today. Through word of mouth I heard he might be planning to come live again close to where I live. Besides a restraining order, can I still file a police report and file for domestic violence against him? I have proof too.

A: More info is needed to properly evaluate your case...but it does sound like a case your local police would be interested in hearing about.

However, it is always a good idea to contact a local attorney that handles DV cases in the local courthouse

In other words, I am in Palm Springs and you don’t want to hire a Palm Springs lawyer for an Orange Co case.

Most criminal and accident lawyers will offer a free consultation to review the facts.

The case will depend on how the evidence was obtained and the details regarding the stop and arrest, as well as a review of the facts of your case.

Call a local attorney to discuss this matter in more detail and request an appointment.

Don't discuss your matter on a platform like this as what you say can be used against you.
