Amherst, MA asked in Immigration Law for Massachusetts

Q: I have visa F1(PhD student) and my husband F2, an employer is offering a permanent job to him (EB3), how to do it?

I understand the EB3 in the category of professionals is the one for my husband. I have a sense of the process but not sure about some things.

Does the employer need to publish the job offer in any particular way, so my husband can apply?

A: There is a very involved, specific process for employment petitions. The employer will need to retain an immigration attorney.

A: Yes. Because the visas are available only to foreign workers who can show they won’t be taking jobs from Americans, the employer has to show that they have done their due diligence to try to find a US worker to fill the position.
