Q: Can my landlord charge me for painting?

Lived in gov. apt. for 2 years move to handy cap apt same building. The walls and carpet we're cleaned. I smoke so landlord says I have to pay for painting. Walls are clean. Lease does not prohibit smoking. Carpet is being replaced because it's over 10 years old. Lease says I am to be present for walkthrough at move out. Appointment day and time was scheduled but landlord did walkthrough without me present. There were no damages other then them telling me that because I smoked I have to pay for painting.
