San Mateo, CA asked in Criminal Law and Civil Rights for California

Q: case was dismissed, but I want to see what evidence was found at arrest. how/where do I get it?

Police state in report that they found 24 grams of what they thought was meth and charged me with felony sales. There was nothing that they could have found that could have been mistaken for 24g of meth. I spent a week in jail before my family had to bail me out. It was not until a few days before pre trial that I got a call saying it turned out to be less then 4 grams so it was now a misdemeanor case which then later was dismissed.

I asked public defender for copy of report/evidence several times but never got it and had different public defender each court date.

I went to clerk office and asked for report w/ photos of evidence and was told they don’t know where I get the photos and that since case was dismissed any evidence and photos would have been destroyed.

I don’t believe this to be true, and if it is then why was I never given the chance to retrieve an iPhone they took and the ounce of marijuana they took?

Can I still see the evidence and or lab report from case?
