Q: How to get guardianship of niece and nephew?

My mom just got temporary custody of my niece and nephew today because of my brother's drug abuse and abuse to the kids. There is a hearing in 5 days to determine the facts. He is charged with assault 4th degree (child abuse) I live in Pennsylvania and my brothers children are in Kentucky. I would like to get guardianship of the children because I feel it would be in their best interest. They will be more stable financially, emotionally, and well taken care of at my house. If go with my mom to support her at the hearing and describes the kids current living conditions, do you think there will be an order of custody would be granted.

A: The temporary custody has already been granted. It will likely remain with her, although you and she could go to probate court to establish the guardianship for the children.
