Chicago, IL asked in Traffic Tickets and Criminal Law for Illinois

Q: I got a traffics ticket for failure to yield/avoid an accident. The cop put an X in the box indicating No Court

Appearance required. The ticket was issued due to an accident. No one was injured or taken to hospital the cop gave me the yellow forms for Driving School to keep the ticket off my record. Now the Circuit Clerks office is staring the cop incorrectly filled out my ticket and I’m required to appear in court, is this normal or correct in the State of IL?

Thank you for your response to my question above. Although the clerk also mentioned that since a court appearance is required I will incur court fees and the price of my ticket will most likely double? As the docket shows “must appear”, do you think the information the police officer has regarding shows as on my ticket, which was not handwritten it was computer generated by the officer the day of the accident or as the circuit clerks office docket ?

A: The cop was mistaken. The clerk is correct. This will probably benefit you because when you show up in court and the other side does not show up, and they rarely do, the case will be dismissed with no fine no traffic school

A: The Clerk is correct. You need to make sure that you appear in court. If you plead guilty or if you are found guilty after trial, mandatory court costs and fees will be assessed against you not including any fine amount, which will be much more then what the ticket says. You may want to consider hiring an attorney to assist you if you are still confused.
