Wilmington, NC asked in Traffic Tickets for North Carolina

Q: can i sue my boyfriend for a ticket i took for him which he has not paid?

He was drinking and driving, at the time i did not know he had been drinking. He hit a lady and tried to do a hit and run but she chased him down. I took the ticket because my son was in the car with us, again I did not know he had been drinking. Can I sue him for not paying the ticket and me having to pay over 4 thousand dollars.

A: Frankly, I don't believe you when you say you didn't know he was drinking and no one else that matters is likely going to believe you either. So regardless of whether that is true or not - you likely should never say that ever again. Ditto for your statement that you took the ticket because you son was in the car - that reason actually makes things look worse for you not better. Obviously you made an incredibly bad decision - don't make an incredibly bad decision worse by trying to sue the jerk who let you do this - odds are he has no money to pay you back anyway. Here's the deal, you likely just admitted to additional crimes on a public forum. If you go poking around into this by yourself - you could find yourself charged with them. Your best bet is to consult with a local criminal law attorney who can review your situation in more detail to see if there is any possible way of unscrewing this situation without putting you into more trouble. If this occurred in New Hanover county call John Phillips at Broadwell & Phillips, PA (910) 686-1736 - if he can not help you he can likely refer you to someone who can. Best of luck and don't ever put your child in a situation like this again - things could have turned out way worse.
