Chino, CA asked in Animal / Dog Law for California

Q: If a vet said he wanted to compensate for what both my dog and I went through. Is that not a legal verbal contract?

My dog received 3 & 4th degree surgery burns. I was out of town for work, and asked for pics cause they wanted to do a biopsyon what they called a bump on her side. I was shocked it was so large. I had no idea what could have happened. Took two months before they took responsibility even after the biopsy report was given to them.

A: Probably not. That is too vague to enforce. Further, you aren't entitled compensation beyond the expense to repair/treat the injury to your dog. Your dog is considered property and there is no emotional distress recovery for damage to property. As a result, any promise to compensate you, beyond the expense to repair/treat your dog, is a promise to make a gift, and promises to make gifts are not enforceable.
